2. Scope of Services

We provide waste clearance and collection services primarily within Shepherds Bush and surrounding areas, including residential households, commercial premises, and other properties where lawful access is granted.

Our Services may include the collection, loading, transportation, and lawful disposal or recycling of general household waste, garden waste, office waste, and certain types of bulky items. The exact nature of the Services to be delivered will be agreed at the time of booking and confirmed in your Order details.

We reserve the right to refuse any waste that is not suitable for manual collection, is too heavy or unsafe to handle, or is prohibited under applicable waste regulations, including hazardous or specialist waste not covered by our standard Services.

3. Booking Process

You may request a quote and make a booking by telephone, email, or through any booking channels we may make available. When you contact us, you will be asked to provide details including the type and approximate volume of waste, location of the property, access information, and preferred date and time for collection.

Any quote given based on your description of the Waste is an estimate only. The final price may vary after our team inspects the Waste on site. If the actual volume or nature of the Waste differs materially from your description, we will advise you of any change in price before commencing the work.

Your Order is confirmed only when we have accepted your booking request and provided you with a booking confirmation, which may be given verbally, by email, or in writing. We reserve the right to decline any booking request at our sole discretion.

The Customer is responsible for ensuring that all information provided during the booking process is accurate, including contact details, property address, description of Waste, and any relevant access restrictions such as parking or building entry requirements.

4. Access and Customer Responsibilities

You must ensure that our team has safe, suitable, and lawful access to the property and the area where the Waste is located on the agreed collection date and time. This includes providing necessary entry codes, keys, permissions, parking arrangements, and clear pathways to the Waste.

Waste should be ready for collection at the agreed time. Where we have agreed to collect from within a property or garden, you must ensure that there are no health and safety risks to our team, such as exposed sharp objects, dangerous structures, or aggressive animals on site.

If we are unable to complete the collection due to inadequate access, unsafe conditions, or failure to provide accurate information, we may charge a call-out or waiting fee and may, at our discretion, treat the visit as a completed Service.

5. Waste Types and Exclusions

We collect most non-hazardous household and commercial waste, including general rubbish, furniture, appliances, office equipment, and garden waste, subject to size and weight limits applicable at the time of Service.

The following waste types are excluded from standard Services unless expressly agreed in advance: asbestos, clinical and medical waste, chemicals, solvents, oils, paints, fuel, gas bottles, hazardous electronic waste, pressurised containers, and any materials classified as hazardous or requiring specialist handling or permits.

Where you present excluded or prohibited Waste for collection without prior agreement, we may refuse to collect such items and may still charge for attendance or partial work completed. You are responsible for ensuring that all Waste presented is lawful to handle and transport under UK waste legislation.

6. Pricing and Quotations

Our pricing is generally based on the type and volume of Waste, the labour required, access conditions, and disposal costs, including any local waste transfer station or recycling fees. We may provide a guide price or price range in advance based on the information supplied by you.

The final price will normally be confirmed following an on-site assessment before any Waste is loaded. If the price is higher than the estimate due to additional volume, more complex access, or the presence of items requiring special handling or disposal charges, you will be informed and may choose whether to proceed.

All prices quoted are exclusive of any additional parking charges, congestion charges, tolls, or similar fees, which may be added where applicable. Any such additional charges will be explained as far as reasonably possible.

7. Payments and Invoicing

Payment is due on completion of the Service unless otherwise agreed in writing. We may accept payment in cash, by card, bank transfer, or other methods notified to you at the time of booking or completion.

For commercial Customers and account holders, payment terms may be agreed separately, and invoices are payable within the period stated on the invoice. We reserve the right to charge interest on overdue amounts at the statutory rate, together with reasonable costs of recovery.

We are not obliged to issue a paper invoice, and confirmation of payment may be provided electronically. You must retain proof of payment for your records. If you dispute any amount invoiced, you must notify us in writing within seven days of the invoice date, providing details of the issue.

8. Cancellations and Amendments

You may cancel or amend your booking by notifying us via the same communication channel used for booking, or as otherwise advised. To avoid charges, cancellations should usually be made no later than 24 hours before the scheduled collection time.

We reserve the right to charge a cancellation fee where you cancel with less than 24 hours notice, where our team has already been dispatched, or where we arrive on site and are unable to proceed due to your act or omission. Any cancellation fee will be proportionate to the time and costs incurred.

If you wish to change the date, time, or scope of the Service, we will use reasonable efforts to accommodate your request but cannot guarantee availability. Changes that increase the scope of work may result in an amended quote and price.

We may cancel or reschedule the Service due to circumstances beyond our reasonable control, including severe weather, vehicle breakdowns, staff illness, or legal restrictions. In such cases, we will seek to offer an alternative appointment at the earliest convenient time, and no cancellation charge will apply.

9. Performance of Services

Our team will carry out the Services with reasonable care and skill, taking into account the nature of waste collection work. We will make reasonable efforts to arrive within the agreed time window, but timing is not guaranteed, and minor delays may occur due to traffic or operational issues.

Where we anticipate a significant delay, we will attempt to contact you using the contact information provided. If you are not present at the property at the agreed time and have not arranged alternative access, we may, at our discretion, wait for a short period or rearrange the appointment, possibly subject to additional charges.

On completion of the Service, our team will make reasonable efforts to leave the collection area in a tidy condition, subject to the constraints of the property and the work undertaken. We are not responsible for deep cleaning, repairs, or making good any pre-existing damage.

10. Title to Waste and Duty of Care

Once the Waste has been loaded onto our vehicle and payment obligations have been met, title to the Waste passes to the Company, and you relinquish all rights and responsibility for it, subject to your duty to provide lawful Waste only.

We operate in accordance with UK duty of care requirements for waste management and will only transport and dispose of Waste at authorised facilities, aiming to maximise recycling and recovery where reasonably practicable.

We may, for operational purposes, separate, sort, or reuse items collected where lawful to do so. You acknowledge that once we have taken possession of the Waste, we may handle it in any lawful manner consistent with applicable waste regulations.

11. Customer Warranties

By using our Services, you warrant and represent that:

You are either the owner of the Waste and the property from which it is collected, or have full authority from the owner to arrange for its removal.

The Waste presented for collection is not hazardous, restricted, or illegal and may lawfully be moved, stored, and disposed of by us under applicable UK waste legislation.

All information provided during booking and prior to collection is accurate, complete, and not misleading, including descriptions of Waste volume, type, and access conditions.

12. Liability and Limitations

We will be liable for direct damage to your property caused by our negligence or breach of contract, subject to the limitations in this clause. Our total liability to you for any loss or damage arising out of or in connection with the Services shall not exceed the total price paid or payable for the relevant Service, except where liability cannot be limited by law.

We are not liable for any indirect or consequential losses, including loss of profit, business interruption, loss of data, or loss of reputation, arising from the provision or non-provision of the Services.

We are not responsible for damage arising from inherent defects in the property, poor structural conditions, pre-existing damage, or any issues resulting from items that you have asked us to move which are fragile, poorly assembled, or unsuitable for manual handling.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

13. Insurance

We maintain appropriate public liability and employer liability insurance in connection with the Services we provide. Details of our insurance cover are available on request. You are responsible for ensuring that you have adequate insurance in place for your property and contents.

14. Complaints

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing your name, address, contact details, and a clear description of the issue. We will investigate and aim to respond within a reasonable period.

Where we agree that the Service has not been carried out in accordance with these Terms and Conditions, we may, at our discretion, offer to re-perform all or part of the Service, provide a partial refund, or make another appropriate goodwill gesture. This does not affect your statutory rights.

15. Data Protection and Privacy

We collect and process personal data such as your name, address, and contact information solely for the purposes of managing bookings, providing Services, processing payments, and handling customer enquiries. We will handle your personal data in accordance with applicable UK data protection laws.

We will not sell your personal information to third parties. We may share necessary details with our staff, contractors, and service providers who assist us in delivering the Services, on a need-to-know basis only.

16. Changes to Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our operational practices, or the scope of our Services. Any updated Terms and Conditions will apply to new Orders placed after the date of change. For existing confirmed Orders, the Terms and Conditions in force at the time of booking will continue to apply unless otherwise agreed.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

You and the Company agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

18. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed deleted, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms and Conditions, together with any written confirmation of your Order and any other documents expressly incorporated by reference, represent the entire agreement between you and the Company in relation to the Services and supersede any prior communications, representations, or understandings.
